"LA TINIDAD, Benguet (Feb. 1) — Affected residents of Kibungan town complained against representatives of Al Magan Mining Exploration Corp. (AMMEC) for alleged encroachment for mineral exploration.
In a petition furnished to the Benguet provincial board, residents of Barangay Lubo, Kibungan, of this province said that the unauthorized entry of AMMEC representatives violated the free prior and informed consent provision of the Indigenous Peoples Rights Act (IPRA) and the 1987 Constitution.
The residents’ petition letter narrated that AMMEC represented by Engr. David Apakway conducted on March 19, 2005 its first ocular inspection and rock sampling without proper consultation with affected residents and local officials. The same petition reported that on December 29, 2006 a group of engineers and other people led by Engr. Emiliano Paleng conducted another round of ocular inspection without consultation despite earlier protests of residents, the petition added.
The petition also reported that a letter from National Commission on Indigenous Peoples (NCIP) by Dir. Leilene Gallardo dated December 20, 2006 stated that there are no pending applications for certification precondition or free prior and informed consent processes filed with the NCIP over the said area.
The said petition letter was originally addressed to Mines and Geosciences Bureau (MGB)-Department of Environment and Natural Resources (DENR) Director Neoman dela Cruz.
Meanwhile, Kibungan Mayor Murphy Paayas said residents are against the mining project in Barangay Lubo because it would affect the town’s vegetable industry. He added that if the mining operations would push through, Lubo and adjacent barangays would suffer from water and other environmental problems"...
