die gestehungskosten für Sapphire wurden falsch eingeschätzt und GTAT hatte bereits 900 Millionen Verlust damit gemacht,es konnte aus dem Vertrag mit Apple sonst nicht raus

...According to statements made in a court filing by GT COO Daniel Squiller, the Merrimack, N.H.-based company, which makes sapphire for use in consumer electronics, entered an agreement with Apple in October 2013 to produce sapphire "in quantities, size and quality never before achieved," Squiller said. According to the agreement, GT was to supply Apple with more than 2,000 sapphire-growing furnaces.

"The transaction had the potential to be revolutionary for GTAT's business and a significant achievement for Apple," Squiller said. But the production of the amount of sapphire that Apple needed during a certain time frame was not achievable and ended up costing more money than anticipated, he said.

"These problems and difficulties resulted in a liquidity crisis at GTAT, which led to the commencement of these Chapter 11 cases," Squiller said. The relationship with Apple ultimately became "unsustainable," he said.

Other interesting facts about the GT-Apple relationship:

   GT was unable to negotiate changes to the pricing regime set forth in the Apple agreements, and GT was selling sapphire material at a substantial loss, Squiller said.
   GT's losses would have increased substantially in 2015 when the price for finished sapphire material was scheduled to decrease under the agreements with Apple.
   GT has incurred approximately $900 million in costs in connection with the Apple project......Last week, the two companies reached a settlement agreement that had GT winding down its operations in Arizona and Salem.

MERRIMACK, N.H., Nov. 4, 2014 (GLOBE NEWSWIRE) -- GT Advanced Technologies Inc. (OTC Pink: GTATQ) today announced that it has signed an amendment to the Settlement Agreement with Apple under which both parties have agreed to waive the condition that GT's October 8th declaration be kept under seal and expunged. GT has filed a motion seeking Bankruptcy Court approval of the Settlement Agreement and the Bankruptcy Court is scheduled to hear such motion on November 25, 2014.

Kann einer mal kurz auf deutsch erklären, was das zu bedeuten hat und wie es da weiter geht?  

dass es eine neue Vergleichsvereinbarung mit Apple gibt. GTAT hat die Genehmigung dieser Vereinbarung beim Konkursgericht beantragt und wird dazu am 25.11. gehört.

ergo-sollte die Insolvenz dadurch abgewendet werden können, stehen dem Kurs rosige Zeiten bevor!

Allerdings kam die Nachricht schon gestern abend raus-den Kurs hatte das zumindest gestern nicht weiter interessiert...hhmm...abwarten

Ganz happige Vorwürfe an Apple, quasi als Schuldiger am "Chapiter 11" bezeichnet, wegen sogenanntem "Knebelvrtrag", der GT Advanced nur sichere schwere (ca. 800 Mio. $) Verluste brachte;

According to Squiller, GT Advanced Technologies Inc (NASDAQ:GTAT) was forced to sell every unit of sapphire material at a significant loss because it cannot negotiate changes to the pricing established by Apple Inc. (NASDAQ:AAPL) in the transaction documents.

“GTAT’s losses would have increased substantially in 2015 when the price for finished sapphire material is scheduled to decrease under the agreements with Apple,” said Squiller.

Squiller emphasized that the combined impact if the actions of Apple Inc. (NASDAQ:AAPL) and its unwillingness to negotiate changes in the agreements prompted GTAT to reluctantly file for chapter 11 to protect the value of its business by removing itself from the iPhone maker’s control.

He said GTAT was shut out of the global market for its valuable sapphire material because of the non-competition provisions of the Apple agreement.

“With a classic bait-and-switch” strategy, Apple presented GTAT with an onerous and massively one-sided deal in the fall of 2013,” said Squiller.

Apple muss jetzt was sinnvolles unternehmen, für seinen guten Ruf, un GT Advanced  T.wieder auf die Beine helfen, falls diese Vorwürfe zutreffen sollten.

Apple wird gar nicht tun für GT. 0,0

Apple wird ein Zeichen setzen für die anderen Zulieferer das man Verträge einhalten muss.

Ist Chapter 11 denn überhaupt genehmigt ? Ich glaube nicht, es kann auch zu einer geregelten Insolvenz kommen.....und dann ist aus Aktie 0,0000 Euro.  

Abwarten- du könntest dich irren, bei den Amis ist vieles möglich...
Immer schön locker bleiben- da könnte noch so manche positive Überraschung kommen....

Aus meiner Sicht wird hier noch etwas gezockt aber am Ende stehen wir bei 0$. Für Zocket interessant aber wer langfristig investieren will wird sich hier die Finger verbrennen.

GT Advanced Technologies Inc. said it sought bankruptcy protection last month because Apple Inc., a key customer, engaged in a “classic bait and switch” strategy that left the company stuck in “an onerous and massively one-sided deal.”

GT Advanced’s GTATQ, +13.44%  Oct. 6 bankruptcy filing stunned investors and creditors because it came less than a year after the company announced a major deal to supply Apple AAPL, +1.21%  with sapphire screens for its devices. Initially, court papers gave little hint of what, exactly, went wrong after Apple financed $439 million worth of GT’s transformation from a maker of machines to a grower of synthetic sapphire.

The new details emerged Friday in a scathing declaration by GT Chief Operating Officer Daniel Squiller. The declaration had previously been filed under seal, but bankruptcy judge Henry Boroff ordered it released.

Squiller wrote Apple had turned GT into a “captive supplier” by “constant interference” and changes in product specifications, for which it didn’t compensate GT.

An Apple spokesman declined to comment.

In a motion seeking to keep Squiller’s declaration under seal, Apple said the filing was intended to “vilify Apple and portray Apple as a coercive bully.” Apple said Squiller’s statements were untrue and defamatory.Apple also said it didn’t trick GT, which it said is a “sophisticated publicly traded company” with its own lawyers. The iPhone maker also noted the deal didn’t work out well for Apple either, as it loaned $439 million and doesn’t have the sapphire it had wanted.

Einer der größten indischen PV-Modulherstellers, Waaree Energies sagte, es würde mit GT Advanced Technologies (GTAT) über die Einbeziehung seiner neuen 'Merlin' Technologie in seine bestehende Produktionslinien zusammenarbeiten. Finanzielle Einzelheiten wurden nicht bekannt gegeben.

Waaree darauf hingewiesen, dass es beabsichtigt, adressieren "Indian unterschiedlichen Bedürfnisse Marktes, die von Multi-Megawatt-Solarparks zu den niedrigen Kosten verteilten Leistungs Implementierungen reichen", mit dem Einsatz von GTAT Zelle Metallisierung und Interconnect-Technologie, die das Unternehmen behauptet, die Beseitigung der Notwendigkeit der Tabulatortaste und Bespannen Prozesse und eine 80% ige Kostensenkung in der Silberpaste Verbrauch und eine insgesamt 10% Kostenreduktion der Systemkosten.

Waaree sagte in der Erklärung, dass es "plant, aggressiv in den indischen EPC / IPP Märkten und bieten branchenspezifische Best-of-Class-LCOE Metriken zu beteiligen."

GTAT hatte bereits im März, sagte 2014, dass es erwartet, die ersten Aufträge für die Merlin-Technologie "bald" und erwartete seinen ersten Kunden in Asien basieren.

Waaree auch darauf hingewiesen, dass zusätzlich zu der GTAT Zusammenarbeit in Indien, beide Unternehmen die Möglichkeit Waaree Errichtung einer US-basierten Modul-Montagewerk, in den US-Markt zu erweitern, mit der Merlin-Technologie zu erforschen.

GTAT Pilot Produktionsstätte für die Merlin-Technologie ist in Kalifornien.

Das Unternehmen erklärte, im August 2014, dass die Technologie hatte geplant Leistung, Sicherheit und Qualitätsstandards unterzogen (IEC 61215, IEC 61730-1 und -2 und UL1703) vor der Kommerzialisierung. Zertifizierungstests erfolgte durch das Erneuerbare-Energien-Testzentrum durchgeführt und überprüft Canadian Standards Association und TÜV-Süd.

In Sachen GT Advanced Technologies Inc., wer weiss wie es weitergeht ?

Soviel ich weiss, können mittels "Chapitre 11" -  vor allem Firmen in finanzieller Bedrängnis - sich die Gläubiger auf Zeit etwas vom Hals gehalten werden,  um so wirtschaftlich doch noch zu überleben.

Also nicht ein Absturz in den KONKURS, sondern die Bewahrung davor.
