Nanotech Gets Down to Business
By Patrick Di Justo
02:00 AM May. 14, 2003 PT
NEW YORK -- If the excitement at New York's NanoBusiness Conference is
any guide, future historians will declare early 2003 to be nanotechnology's tipping point, the pivot on which the industry slid from "not quite ready" to "raring to go."
In a little less than a year since the last conference, major corporations like General Electric and the various remains of Bell Labs have formed, increased funding for or spun off dedicated nanotech units. Though the venture capital community has shrunk back to mid- 1990s levels of funding, the big venture- capital players like Venrock, Polaris and Kleiner Perkins Caufield & Byers are all investing what money they have in nanotech.
"It's not a fad. It's integral to technology companies' R&D pipeline, and the sophisticated investors know that," said Josh Wolfe, a co-founder and Managing Partner of Lux Capital focusing on investments in nanotechnology.
Even the government is getting in on the nano action. Earlier this year, President Bush's 2004 budget increased funding for the National Nanotechnology Initiative by about 9.5 percent, to $847 million. And just last week, the House passed a nanotech funding bill, allocating $2.36 billion in research money over the next three years to NASA, the National Science Foundation, the EPA and the Departments of Energy and Commerce.
Part of the excitement comes from a report (PDF) by the National Science Foundation indicating that nanotechnology had the potential to grow into a $1 trillion-per-year industry. But most of the excitement comes from a growing acceptance in the business community and by the general public that nanotechnology exists here, right now and it's getting smaller all the time.
While the sexy, sci-fi images of nanotechnology are hype, real nanotech products are coming onto the scene through the back door.
SI Diamond Technology has been making low-power MRI displays based on carbon nanotubes for about a year. Inframat has developed a ceramic coating that bonds to metal on a nano level, making it resistant to peeling and the Navy is using it on submarines. Cambridge Display Technology makes light-emitting polymer displays that are about to be installed in the London metro. The Kodak EasyShare LS633 digital camera also uses a nanostructured LEP display, as will just about every laptop for sale this Christmas. Cymbet makes thin film polymer batteries that power RFID tags.
One can arrange silicon atoms into a molecular sieve only so many ways, for example, which is why Steve Maebius is here talking to inventors. Maebius is a partner in the Intellectual Property department of Foley and Lardner, the 12th-largest law firm in the United States. He works with nanotech companies, helping them navigate the patent application and licensing minefield.
Natural quantum forces that arrange atoms into particular shapes cannot be patented, Maebius admits. What can be protected are the controlled environmental conditions that cause the atoms to take that particular shape. "As soon as you involve the hand of man in manipulating those conditions, at that point you may have something patentable," he says.
But maybe not. Nanotech patents are just now starting to make their way through the convoluted U.S. patent system; about 2,800 nano-related applications have been filed in the past six years. The patent process is slow, however, taking as much as six years from application to issuance.
Nano-researchers are warned against publishing their discoveries in peer-reviewed journals for fear of tainting their exclusive rights. So while an invention is working its way through the patent process, other researchers could be replicating the work, wasting time rediscovering the invention.
This confusion over who did what first can have a negative impact on a company's attractiveness to venture capitalists. In the battle between the quality or the quantity of a nanotech company's intellectual property holdings, quality doesn't always win.
"I think some venture capitalists approach IP as kind of a checklist," Maebius explains. "If a company has lots of patents, they think 'Wow, this really looks good.' That's unfortunate, because some of the early broad patents have been snapped up by some large companies."
For example, a small startup obtains a patent for a new way to make carbon nanotubes. Their ability to market that product may be blocked by the company that holds the patent on the original carbon nanotube. "The only way around this is to approach the original patent holder and negotiate a collaboration or a cross license. Otherwise nobody can practice in these overlapping areas," Maebius says.
Because of IP problems like this, and because they still remember their dot-com debacle, venture capitalists are now wary of nanotech startups. Emmanuel Barros, who attended the NanoBusiness conference last year to raise funds for his fabrication company, NanoMatrix, is sitting this year out. "We tried the dog and pony act to attract funding, but VCs were unrealistic about the returns and risk," he explained in an e-mail interview.
Josh Wolfe agrees that, while eager to invest in nanotechnology in the abstract, some VC firms might be reluctant to invest in specific nanotech companies for a variety of reasons. "The first is a lack of understanding of physical and material sciences, (but) most importantly, they can't invest in nanotech if they don't have the deal flow to work from."
The lack of published information about the latest nanotech progress may discourage some investors. Many VCs prefer nanotech subsidiaries of large companies, rather than small nanotech startups, because the large companies usually have the resources to find out what other researchers are doing, thus helping to ensure that their researchers are not wasting their time.
"They wanted everything, but with little risk," Barros says of the venture capitalists he's dealt with. "We quit looking for funding and focused on clients. After all, the client's money is just as good as the VC's, except the client wants product and no stock. I haven't found a single VC that can beat that deal."
According to Barros, NanoMatrix is developing products and gaining clients without a shred of outside funding. "How soon we'll be in the black is anybody's guess, but we certainly are hopeful and have tremendous potential."

Nanomaterials
Thursday May 15, 8:01 am ET
ROMEOVILLE, Ill., May 15 /PRNewswire-FirstCall/ -- Nanophase Technologies
Corporation (Nasdaq: NANX - News), a technology leader in nanomaterials and
nanoengineered products today announced commercial availability of doped zinc oxide
nanomaterials. The zinc oxide dopants include aluminum, copper, and silver at dopant
levels ranging from several ppms to several percent. Doped zinc oxide nanomaterials
are targeted at a wide variety of potential applications including antimicrobial agents
(antifungal, antibacterial, and antifouling), opto-electronics, and tailored UV absorption.
(Logo: http://www.newscom.com/cgi-bin/prnh/20030422/NANXLOGO )
Dr. Ed Ludwig, Nanophase's Vice President of Business Development, stated, "Zinc
oxide based materials are known to offer significant benefits as antimicrobial agents.
They have demonstrated antimicrobial activity, are non- irritating, and absorb moisture
and odors. Their thermal stability imparts permanence to their activity and enables
these materials to be incorporated into plastics and on surfaces that experience
extreme processing or harsh application environments -- yet they remain active. In
addition they are GRAS ('generally regarded as safe') materials."
Dr. Ludwig also believes that doped zinc oxides may have applications as
opto-electronic materials. Zinc oxide is a semiconductor; doping zinc oxide allows the
band gap to be changed -- affecting the optical (absorption of UV radiation), electrical,
and magnetic material properties. While still early in application development, the
Company is interested in the potential to tailor doping levels of zinc oxide to
nanoengineer materials for targeted applications, including semi-insulating substrates,
UV LEDs, laser diodes, photodetectors, and conductive materials.
Nanophase's doped zinc oxides are non-porous, dense, discrete, homogeneous,
single-phase crystals. Doped zinc oxide nanomaterials are commercially produced
using Nanophase's patented PVS technology at varying compositions, which are
adjusted to meet specific application requirements, in discrete nanoparticle size ranges
less than 100 nanometers. Nanophase has annual commercial production capability for
zinc oxide and doped zinc oxide nanomaterials in the metric tons range and offers
these nanostructured materials as nanopowders and as dispersions using its
proprietary (patent pending) dispersion technologies. All of Nanophase's
nanoengineered products are manufactured under the Company's cGMP and
ISO-9001: 2000 quality system.
Stellt sich die Frage, ob wieder mal gilt "Buy the rumour, sell the news", oder ob es jetzt erst recht abgeht.

Cepheid Announces United States Postal
Service (USPS) Biodetection Contract Award to
Northrop Grumman
Monday May 19, 3:48 pm ET
SUNNYVALE, Calif., May 19 /PRNewswire-FirstCall/ -- Cepheid (Nasdaq: CPHD - News)
today announced that the United States Postal Service (USPS) has awarded Northrop
Grumman Corporation's (NYSE: NOC - News) Security Systems LLC unit a contract to
manufacture and integrate Biohazard Detection Systems (BDS) designed to rapidly
analyze and detect potential biological threats at Postal Service mail sorting facilities
nationwide. Value of the contract is approximately $175M.
Northrop Grumman is the prime contractor and systems integrator of the BDS, which
uses polymerase chain reaction (PCR) technology, developed by Cepheid, to rapidly
analyze air samples taken from the mail sorting systems and detect trace levels of DNA
from anthrax spores and other biological agents as it moves through the mail
processing equipment. The BDS incorporates Cepheid's GeneXpert® modules as its
detection and identification system and utilizes Cepheid's patented test cartridges.
Commenting on the program, Cepheid Chairman, Tom Gutshall stated:
"We conceived and developed the GeneXpert system to allow the benefits of what is
otherwise complex genetic testing to be realized in virtually any setting. It is gratifying to
see the full benefit of the system being realized in meeting the demanding and unique
needs of the USPS on a totally automated basis. Northrop Grumman has led
development of this technologically advanced and effective solution for biothreat
detection for postal automation."
Cepheid's GeneXpert system utilizes the polymerase chain reaction (PCR) to amplify
and detect target DNA. The system is the first to fully automate and integrate all the
steps required for PCR-based DNA testing: sample preparation, DNA amplification and
detection. Designed for use by a minimally skilled operator, the system provides PCR
test results from a raw sample in 30 minutes or less, enabling time-critical DNA tests at
the point of need. Current techniques for accomplishing this same series of procedures
require extensive labor by skilled technicians and can take hours to several days to
deliver results.

Josh Wolfe, Forbes/Wolfe Nanotech Report, 03.19.03, 11:45 AM ET
NEW YORK - As the U.S. enters into its first full-scale international conflict in more than
a decade, military technology has taken front stage. Technology often causes titanic shifts
in military strategy. The atomic bomb rewrote the rules of military engagement. The last
Gulf War used technology to eliminate some of the need for massive use of ground troops
and saved thousands of lives, according to William Schneider, chairman of the Defense
Science Board under Defense Secretary Donald Rumsfeld.
Most combat technologies likely to be showcased in Iraq are already in the arsenal, but
today the U.S. is financing the development of more-advanced military technologies to
deal with future threats. "After 9/11, there was an intensified interest and availability of
resources to address the military transformation for the 21st century," says Schneider.
The Department of Defense is not your average customer. With a 2003 budget of $379
billion, its buying power is massive. The Defense Science Board recently compiled a
study for the DoD that highlighted nanotechnology as one of the six technology areas
earmarked for big money. It regularly briefs Rumsfeld, and Schneider says Rumsfeld is
well aware of what nanotech can do.
After the National Science Foundation, the DoD is the largest supporter of nanotech
research. As part of the National Nanotechnology Initiative's $710 million 2003 budget,
the DoD is committing $201 million for research in nanoelectronics, magnetics,
nanomaterials by design, and detection and protection against chemical, biological,
radiological and explosive threats.
Schneider anticipates the military will adopt a larger presence in driving tech development
in the coming years. It will pick up some of the slack left as corporations retrench and clip
research and development.
One trend in the military that has grown more prevalent since the Gulf War is modern
technology's ability to reduce the need for troop presence. Defense leaders are optimistic
about the prospect of nanosensors being deployed in combat. These nano-enabled
sensors will be extraordinarily precise, incredibly tiny and lightweight. Satellites and J-Star
radar systems in 707 planes are part of the solution, but tiny, mobile and cheap sensors
that can detect enemy troop movements will fill in the blanks. "Nanoscale sensors have
the potential to dispel the fog of war," says Schneider. "Richness in sensors allows
commanders to have a complete picture of the tactical battlefield."
The ability of the nanosensors to detect the presence of single molecules of selected
substances will be most relevant to homeland defense and combat against foes like Iraq.
Many companies have moved into the sensor market to work on biological and chemical
warfare protection. Companies like Cepheid (nasdaq: CPHD - news - people ) and Ibis
Therapeutics (nasdaq: ISIP - news - people ) are moving down from the micro-scale to
identify chemical and biological threats.
In May, the Army gave Cepheid a $3.4 million contract to develop reagents for detection
of biothreats and other pathogens. Meanwhile, some of the nanoscale approaches to
chemical and biological threats from university-based nanotech research are gaining
steam. Last month, Chad Mirkin's Northwestern spinoff Nanosphere entered into a
development contract with the U.S. Government Technical Support Working Group to
use Nanosphere's proprietary biomolecular detection system (using gold nanoparticles)
for detection of biological warfare agents like anthrax. Charles Lieber's Harvard spinout
Nanosys anticipates having a commercial nano-enabled sensor product within the next>/b>

WEDNESDAY, MAY 28, 2003 4:30 PM
- PR Newswire
SAN DIEGO, May 28, 2003 /PRNewswire-FirstCall via COMTEX/ -- Nanogen, Inc. (NGEN) announced today that it has been issued U.S. Patent No. 6,569,382, "Methods and Apparatus for the Electronic, Homogeneous Assembly and Fabrication of Devices," by the U.S. Patent and Trademark Office. This patent relates to electronic fabrication of micro and nanoscale devices and is the first to issue in a series of applications filed to broaden Nanogen's core proprietary technology. Nanogen has had five patents issued year-to-date, bringing the Company's total number of issued patents to 52 in the United States.
The new patent relates to methods to integrate micro and nanoscale components, such as light emitting diodes (LED) for displays, highly integrated biosensors and micromechanical devices, into higher order structures and devices. Using electroosmotic forces, component devices can be moved through a fluidic medium to a desired target location on a substrate or motherboard through electronic self-assembly fabrication. The heterogeneous assembly of microelectronic, microoptical and micromechanical components on an integrated silicon circuit illustrates the usefulness of these nanofabrication methods that go beyond lab-on-a-chip applications. These nanofabrication techniques could lead to faster, lower cost and more complex higher order devices and structures.
"One of the challenges to producing miniaturized products using nanoscale components will be the integration of these devices with existing microelectronic components. The electronic 'pick and place' fabrication processes described in the patent facilitate the bringing together of micro and nanoscale components thereby helping solve scaling issues. By combining the best aspects of top-down and bottom-up fabrication through Nanogen's proprietary electronic self assembly technology, nanoscale materials and components can be combined to form higher order devices," said Dr. Michael J. Heller, co-founder of Nanogen, one of the inventors, and currently a Professor in the Departments of Bioengineering and Electrical and Computer Engineering at the University of California, San Diego.
"We believe the technology described by Nanogen's new patent could provide a key technological advantage for nanofabrication across many diverse applications of nanotechnology," said Howard Birndorf, Nanogen chairman and CEO. "The issuance of this patent is a product of our continuing efforts to increase and broaden our intellectual property portfolio."
